F-L is the seller of the products that customers can purchase on the website francescalucignano.it.

These General Terms and Conditions of Sale apply to all orders placed on the website francescalucignano.it in accordance with the procedures and terms set forth in the section "How to Place an Order."

RECIPIENTS OF THE COMMERCIAL OFFER
F-L offers its products for sale to "consumers" and professional individuals.
The sales conditions that refer to the Consumer Code regulations (B2C) apply exclusively to purchases made by consumers.

For professional individuals, the ordinary provisions of the civil code and regulations on telematic distance selling between professionals (B2B) apply.
By "consumer," we mean a natural person who acts for purposes unrelated to any entrepreneurial, commercial, artisanal, or professional activity they may carry out.

SUBJECT MATTER OF THE CONTRACT
These General Terms and Conditions of Sale concern the purchase of products offered by F-L, made remotely via the telematic network ("internet") between the seller and the recipient of the commercial offer.

PRODUCT PRICES
All prices include VAT.

Prices do not include shipping and/or insurance costs, which can be viewed during the order finalization process and before its submission.
Prices may be changed at any time without notice.
Therefore, please ensure you check the final price before concluding a purchase.

WARRANTIES
All products sold on the website are covered by the legal warranty of conformity provided for by Articles 128-135 of the Consumer Code ("Legal Warranty"), provided that the customer can demonstrate the purchase by keeping the purchase receipt or invoice issued at the time of sale.

The Legal Warranty is reserved for consumers. Therefore, it only applies to users who have made a purchase on the website for purposes unrelated to any entrepreneurial, commercial, artisanal, or professional activity they may carry out. Those who have purchased on the website and do not have consumer status will be subject to warranties for defects in the item sold, warranties for promised and essential quality defects, and other warranties provided for by the civil code, along with their terms, forfeiture, and limitations.
The Legal Warranty does not cover cases in which the descriptive photographs of the products for sale on the francescalucignano.it website do not faithfully correspond to reality due to monitor settings, browser settings, or other malfunctions unrelated to F-L.
All products for sale on the francescalucignano.it website are sealed and labeled. F-L reserves the right not to accept the return of products that lack their respective seal and/or label.
Due to the peculiarities of F-L's products, in the event of any damage caused by the products, F-L declines all responsibility, which remains the responsibility of the respective manufacturer in accordance with Articles 111 and 114 of the Consumer Code.

It is understood that F-L will provide the damaged party with the maximum assistance in transmitting all necessary information to correctly identify the manufacturer.
Non-compliance must be reported to the seller, under penalty of forfeiture of the warranty, within two months from the date on which it was discovered, by email or registered letter with return receipt requested.
The Legal Warranty covers original defects in the product (i.e., defects existing at the time of delivery) that manifest within 24 months for consumers and 12 months for all other categories of buyers. Defects arising from wear, poor maintenance and/or preservation, tampering, etc., are expressly excluded from the warranty.

The action aimed at asserting hidden defects in a product is time-barred in any case within 24 months from the date of delivery.

HOW TO PLACE AN ORDER
To place an order on the francescalucignano.it website, the user must have a valid email address, as well as meet the legal requirements to enter into the relevant purchase contract. An order can be placed by following these steps:

• Complete the order form following the instructions. • To submit the order form to F-L, click "Buy." When F-L receives the order form you have sent, the purchase offer will be considered made.
• Following receipt of the order form, F-L will send an order receipt via email, which will include the information already indicated in the order form (essential product features, price, delivery charges, payment and delivery methods, link to the "Returns" section), and will proceed to execute the purchase order.
• The order will be stored in the francescalucignano.it database and can be viewed at any time by accessing the "Account" and entering the data through the "Login" functionality.
  The purchase contract for one or more products will be considered concluded only when F-L communicates to the customer the shipment of the respective product.
  F-L reserves the right not to process purchase orders with missing or incorrect data, or that do not provide guarantees of solvency. In these cases, the user will be informed via email of the non-execution of the order and the reasons for it.
  F-L also reserves the right not to process purchase orders if the products are, for any reason and even temporarily, unavailable. In this case, within 3 (three) days of receiving the order, F-L will inform the user via email that the product is not available and will refund any amount already paid.
  F-L reserves the right to accept purchase orders exclusively for products to be shipped to the countries listed on the "International Shipping" page of the francescalucignano.it website.
  If the ordered products are available and F-L intends to accept the purchase order, F-L undertakes to process the order and ship the products within 2 (two) days. F-L is exempt from any liability for delays in product delivery that are independent of F-L's conduct, for example, because they depend on the courier service responsible for the delivery (e.g., strikes, etc.).

PayPal
Bank Transfer
Debit and Credit Card

If the customer makes payment through PayPal, F-L guarantees that the payment procedure will be managed by the PayPal payment gateway without F-L obtaining any banking or financial data. In no case will F-L retain data regarding such information.
If the customer makes payment by Advance Bank/Postal Transfer, order processing will begin once the full order amount is credited to the account held by Francesca Lucignano, approximately within 1-5 business days.

The bank transfer's reason must include: The date and order number - Name and surname of the ordering party. At the time of order confirmation, the customer will receive an email with all the details for making the transfer.

Bank or cashier's checks are not accepted.

SHIPPING: TIMES AND DELIVERY
Except for cases of partial or total unavailability of products, in the event F-L decides to process the purchase order, F-L undertakes to deliver the product or products to the courier no later than 2 (two) days from the date the purchase order is sent. Accepted orders will be shipped and delivered via a courier selected by F-L. To learn all the details about shipping and product delivery methods, please consult the "Delivery & Transport" section. Please read the contents of the "Delivery & Transport" section because it is an integral and substantial part of these General Terms and Conditions of Sale and is considered fully known and accepted by the customer upon submission of the order form. F-L is exempt from any liability for delays in product delivery that are independent of F-L's conduct, for example, because they depend on the courier service responsible for delivery (e.g., strikes, etc.).

RIGHT OF WITHDRAWAL
The customer who qualifies as a consumer has the right to withdraw from the purchase contract entered into with F-L, without any penalty and without specifying the reasons. The withdrawal period expires after 14 (fourteen) days from the date on which the customer or a third party, other than the courier and the designated customer, physically takes possession of the products.

In case of withdrawal from this contract, F-L will reimburse the customer for all payments made to F-L, including delivery costs (except for any additional costs resulting from the customer's choice of a delivery method other than the standard method offered by F-L), without undue delay and, in any case, no later than 14 (fourteen ) days from the day on which F-L receives the returned products or the customer has unequivocally demonstrated that they have returned the products, depending on which situation occurs first.
The returned products must be sent to F-L without undue delay and, in any case, within 14 (fourteen) days from the date on which the customer communicated their intention to withdraw. The postmark date or courier delivery date will be considered. The shipping costs for returned products will be entirely borne by the customer.
Refunds will be made using the same means of payment used for the initial transaction.
The customer will be solely responsible for the decrease in the value of the goods resulting from handling the goods differently than necessary to establish the nature, characteristics, and functioning of the products.
It is specified that:

1. It is absolutely forbidden to remove seals or labels;
2. Products must be returned in good condition, clean, intact, and complete, including any accessories;
3. It is forbidden to use the products for "trial" purposes before returning them.
4. The right of withdrawal does not apply to sealed products opened by the consumer or to sealed goods that are not suitable to be returned for reasons of hygiene or related to health protection, which have been opened after delivery.
5. The right of withdrawal is reserved exclusively for consumers (natural persons who purchase goods for purposes unrelated to their own professional, commercial, or entrepreneurial activity), and therefore cannot be exercised by legal persons or natural persons acting for purposes related to any professional activity they may carry out.

In the event that the customer does not comply with the withdrawal and return terms and conditions mentioned above, or the provisions referred to in the previous points 1), 2), 3), 4), and 5), F-L will not be required to refund the purchase price of the products to the customer. In the event that the customer has still returned such products, they may request F-L to resend the same purchased items, but with shipping costs fully borne by the customer who has violated the withdrawal rules.
Please refer to the "Exchanges and Returns" section for further details on the methods, terms, and conditions for exercising the right of withdrawal. Please note that the content of the "Returns" section is an integral and substantial part of these General Terms and Conditions of Sale and is considered fully known and accepted by the customer upon submission of the order form.

F-L undertakes to respond to complaints in writing via email within 3 days of receiving the report or complaint.

MODIFICATION OF GENERAL TERMS AND CONDITIONS OF SALE

TRADEMARKS AND IMAGES
Trademarks and images belonging to third-party manufacturers used on this website do not belong to francescalucignano.it and are to be considered the exclusive property of their respective owners. F-L è il venditore dei prodotti che il cliente può acquistare sul sito francescalucignano.it

Le presenti Condizioni Generali di Vendita si applicano a tutti gli ordini d'acquisto effettuati sul sito francescalucignano.it secondo le modalità ed i termini indicati al successivo punto ”Come concludere un ordine d’acquisto”.

DESTINATARI DELL'OFFERTA COMMERCIALE
F-L offre in vendita i prodotti a “consumatori” e soggetti professionali.
Le condizioni di vendita che riferiscono alle normative del Codice del Consumatore (B2C) si applicano esclusivamente agli acquisti effettuati da consumatori.

Per quanto riguarda i soggetti professionali, si applicano le ordinarie disposizioni del codice civile e delle normative sul commercio a distanza per via telematica tra professionisti (B2B).
Per “consumatore”, si intende la persona fisica che agisce per scopi estranei all'attività imprenditoriale, commerciale, artigianale o professionale eventualmente svolta.

OGGETTO DEL CONTRATTO
Le presenti Condizioni Generali di Vendita hanno per oggetto l'acquisto di prodotti dedicati da F-L, effettuato a distanza tramite rete telematica (“internet”) tra il venditore ed il destinatario dell'offerta commerciale.

PREZZI DEI PRODOTTI
Tutti i prezzi sono da intendersi comprensivi di IVA.

I prezzi non includono le spese di spedizione e/o assicurazione che potranno comunque essere visionati in sede di conclusione dell'ordine e prima dell'invio dello stesso.
I prezzi possono essere modificati in qualsiasi momento, senza alcun preavviso.
Si domanda, pertanto, di accertarsi del prezzo finale prima di concludere un ordine d'acquisto.

GARANZIE
Tutti i prodotti venduti sul Sito sono coperti dalla garanzia legale di conformità prevista dagli artt. 128-135 del Codice del Consumo (''Garanzia Legale'') purché il cliente possa dimostrarne l'acquisto conservando ricevuta dell'acquisto o relativa fattura emesso all'atto della vendita. .

La Garanzia Legale è riservata ai consumatori. Essa, pertanto, trova applicazione, solo agli utenti che hanno effettuato l’acquisto sul Sito per scopi estranei all’attività imprenditoriale, commerciale, artigianale o professionale eventualmente svolta. A coloro che hanno acquistato sul Sito e che non rivestano la qualità di consumatori saranno applicate la garanzie per i vizi della cosa venduta, la garanzia per difetto di qualità promesse ed essenziali e le altre garanzie previste dal codice civile con i relativi termini, decadenze e limitazioni.
La Garanzia di conformità non copre i casi in cui le fotografie descrittive dei prodotti in vendita sul sito francescalucignano.it non dovessero corrispondere fedelmente al reale a causa delle impostazioni del monitor, del browser o di eventuali altri malfunzionamenti indipendenti da F-L.
I prodotti in vendita sul sito francescalucignano.it sono tutti sigillati ed etichettati. F-L si riserva il diritto di non accettare la restituzione di prodotti che siano privi del loro relativo sigillo e/o etichetta.
In ragione della peculiarità dei prodotti venduti da F-L, in caso di eventuali danni causati dai prodotti, F-L declina ogni responsabilità, la quale resta a carico del relativo produttore ai sensi degli artt. 111 e 114 Codice del Consumo.

Resta inteso che F-L fornirà al danneggiato la massima assistenza nel trasmettere al danneggiato tutte le necessarie informazioni volte ad individuare correttamente il produttore.
Il difetto di conformità deve essere denunciato al venditore, a pena di decadenza dalla garanzia, nel termine di due mesi dalla data in cui è stato scoperto a mezzo email o lettera raccomandata A/R.
La garanzia legale copre i difetti originari del prodotto (cioè già esistenti al momento della consegna dello stesso) che si manifestino nell'arco di 24 mesi per i consumatori e nell'arco di 12 mesi per tutte le altre categorie di acquirenti. Sono espressamente esclusi dalla garanzia i difetti sopravvenuti e derivanti da usura, cattiva manutenzione e/o conservazione, manomissione, etc.

L'azione diretta a far valere i vizi occulti di un prodotto, si prescrive, in ogni caso nel termine di mesi 24 dalla avvenuta consegna.

COME CONCLUDERE UN ORDINE D'ACQUISTO
Per poter effettuare un ordine d'acquisto sul sito francescalucignano.it, è necessario che l’utente sia in possesso di un valido indirizzo e-mail, oltre che ai requisiti di legge per stipulare il relativo contratto d’acquisto. Si può effettuare un ordine d'acquisto seguendo questa procedura:

• A questo punto, per trasmettere il modulo d'ordine a F-L, cliccare su “Acquista”. Nel momento in cui F-L riceverà il modulo d'ordine che hai inviato, la proposta d’acquisto si considererà inoltrata.
• A seguito della ricezione del modulo d'ordine, F-L si riserverà di trasmettere via e-mail una ricevuta dell'ordine, in cui saranno riportate le informazioni già indicate nel modulo d'ordine (caratteristiche essenziali dei prodotti, prezzo, spese di consegna, modalità di pagamento e di consegna, link alla sezione “Resi”) e provvederà a dare esecuzione all’ordine d'acquisto.
• L’ordine sarà archiviato nel database di francescalucignano.it e potrà essere visionato in qualsiasi momento accedendo all’“Account” inserendo i dati attraverso la funzionalità “Login”.
  Il contratto d’acquisto di uno o più prodotti si considererà concluso soltanto nel momento in cui F-L comunicherà al cliente l’avvenuta spedizione del relativo prodotto.
  F-L si riserva il diritto di non dare esecuzione agli ordini d'acquisto con dati mancanti o non corretti, oppure che non forniscano garanzia di solvibilità. In questi casi, l’utente sarà informato tramite e-mail della mancata esecuzione dell'ordine e dei relativi motivi.
  F-L si riserva inoltre il diritto di non dare esecuzione agli ordini d'acquisto qualora i prodotti risultassero, per qualsiasi motivo e anche solo temporaneamente, indisponibili. In questo caso, entro 3 (tre) giorni dalla ricezione dell’ordine, F-L informerà l’utente via e-mail che il prodotto non è disponibile e provvederà al rimborso di quanto eventualmente già pagato.
  F-L si riserva il diritto di accettare esclusivamente gli ordini d'acquisto relativi a prodotti da spedire nei Paesi elencati nella pagina “Spedizioni Internazionali” del sito francescalucignano.it
  Ove i prodotti ordinati siano disponibili e F-L intenda accettare l’ordine d’acquisto, F-L si impegna a processare l’ordine e ad effettuare la spedizione dei prodotti entro 2 (due) giorni. F-L è esente da qualsiasi responsabilità per ritardi nella consegna dei prodotti che siano indipendenti dalla condotta di F-L, ad esempio perché dipendenti dal servizio erogato dal corriere che ha in gestione la consegna.

PAGAMENTI

Bonifico Bancario
Carta di debito e di credito

Se il cliente effettua il pagamento tramite Paypal, F-L garantisce che la gestione della procedura di pagamento sarà gestita dal gateway di pagamento Paypal senza che F-L entri in possesso di alcun dato bancario o finanziario. In nessun caso F-L custodirà dati riguardanti tali informazioni.
Se il cliente effettua il pagamento con Bonifico Bancario/Postale Anticipato la procedura di evasione dell'ordine verrà avviata una volta accreditato l'importo dell'intero ordine sul C/C intestato a Francesca Lucignano, (circa 1-5 giorni lavorativi).

La causale del bonifico dovrà riportare: La data e il numero dell'ordine - Nome e cognome dell'ordinante. Al momento della conferma dell'ordine il cliente riceverà una mail con tutti gli estremi per effettuare il bonifico.

Non sono ammessi assegni bancari o circolari.

SPEDIZIONE: TEMPI E CONSEGNA
Fatto salvo il caso della parziale o totale indisponibilità dei prodotti, nel caso in cui F-L decida di dare esecuzione all’ordine d’acquisto, F-L si impegna a consegnare il prodotto o i prodotti al corriere al più tardi entro 2 (due) giorni dalla data d’inoltro dell’ordine d’acquisto. Gli ordini accettati saranno spediti e consegnati tramite corriere selezionato da F-L. Per conoscere tutti i dettagli sulle modalità di spedizione e consegna dei prodotti, è necessario consultare la sezione “Consegna & Trasporto”. Si invita a leggere il contenuto della sezione “Consegna & Trasporto” perché esso è parte integrante e sostanziale di queste Condizioni Generali di Vendita e, pertanto, si considera conosciuto ed accettato integralmente al momento dell'invio del modulo d'ordine. F-L è esente da qualsiasi responsabilità per ritardi nella consegna dei prodotti che siano indipendenti dalla condotta di F-L, ad esempio perché dipendenti dal servizio erogato dal corriere che ha in gestione la consegna (es. scioperi, etc.).

DIRITTO DI RECESSO
Il cliente che riveste la qualità di consumatore ha il diritto di recedere dal contratto di acquisto stipulato con F-L, senza alcuna penalità e senza indicarne le ragioni. Il periodo di recesso scade dopo 14 (quattordici) giorni dalla data in cui il cliente o un terzo, diverso dal corriere e dal cliente designato, acquisiscono il possesso fisico dei prodotti.

In caso di recesso dal presente contratto, saranno rimborsati al cliente tutti i pagamenti che ha effettuato a favore di F-L, compresi i costi di consegna (ad eccezione dei costi supplementari derivanti dalla eventuale scelta da parte del cliente di una tipologia di consegna diversa da quella standard offerta da F-L), senza indebito ritardo e in ogni caso non oltre 14 (quattordici) giorni dal giorno in cui F-L riceve i beni prodotti restituiti o il cliente ha inequivocabilmente dimostrato di aver rispedito i beni, a seconda di quale situazione si verifichi prima.
I prodotti resi devono essere spediti a F-L senza indebito ritardo ed in ogni caso entro 14 (giorni) dalla data in cui il cliente ha comunicato a F-L la sua intenzione di recedere. Farà fede la data di invio postale o di consegna al corriere. I costi di spedizione dei prodotti resi saranno integralmente a carico del cliente.
I rimborsi saranno effettuati utilizzando lo stesso mezzo di pagamento usato per la transazione iniziale.
Il cliente sarà unicamente responsabile della diminuzione del valore dei beni risultante da una manipolazione dei beni diversa da quella necessaria per stabilire la natura, le caratteristiche ed il funzionamento dei prodotti.
Si precisa che:

1. È assolutamente vietato rimuovere sigilli o etichette;
2. I prodotti devono essere spediti sani, puliti, integri e completi, anche di eventuali accessori;
3. È vietato utilizzare i prodotti per finalità di “prova” prima di effettuare il reso.
4. Il diritto di recesso non si applica ai prodotti sigillati aperti dal consumatore, nè ai beni sigillati che non si prestano ad essere restituiti per motivi igienici o connessi alla protezione della salute che sono stati aperti dopo la consegna.
5. Il diritto di recesso è riservato esclusivamente ai consumatori (persone fisiche che acquistano i beni non per scopi legati alla propria attività professionale, commerciale o imprenditoriale), quindi non può essere esercitato dalle persone giuridiche e dalle persone fisiche che agiscono per scopi riferibili all'attività professionale eventualmente svolta.

Nel caso in cui il cliente non rispetti i termini per il diritto di recesso e di reso sopraindicati, oppure le disposizioni di cui ai precedenti punti 1), 2), 3), 4) e 5), F-L non sarà tenuta a rimborsare il prezzo d’acquisto dei prodotti al cliente. Nel caso in cui il cliente abbia comunque restituito tali prodotti, potrà domandare a F-L di rinviargli i medesimi articoli acquistati, ma con spese di rispedizione integralmente a carico del cliente che ha violato le norme sul diritto di recesso.
Si invita a consultare la sezione “Cambi e Resi” per conoscere gli ulteriori dettagli su modalità, termini e condizioni per l'esercizio del diritto di recesso. Si ricorda che il contenuto della sezione “Resi” è parte integrante e sostanziale di queste Condizioni Generali di Vendita e si considera conosciuto ed accettato integralmente dal cliente al momento dell'invio del modulo d'ordine.

SERVIZIO CLIENTI E RECLAMI

F-L si impegna a rispondere ai reclami per iscritto a mezzo email entro giorni 3 dalla ricezione della segnalazione o reclamo.

PRIVACY POLICY
F-L si pone l'obiettivo di tutelare al massimo la privacy degli utenti. Per conoscere le modalità di trattamento dei dati personali dell’utente e per avere ulteriori informazioni sulla nostra Privacy Policy, si invita a consultare la sezione “Privacy Policy”.

MODIFICA DELLE CONDIZIONI GENERALI DI VENDITA
