Right of withdrawal

The customer who qualifies as a consumer has the right to withdraw from the purchase contract entered into with F-L, without any penalty and without stating the reasons. The withdrawal period expires after 14 (fourteen) days from the date on which the customer or a third party, other than the carrier and the designated customer, physically acquires possession of the products.

In the event of withdrawal from this contract, all payments made by the customer to F-L, including delivery costs (except for any additional costs resulting from the customer's choice of a delivery method other than the standard one offered by F-L), will be refunded to the customer without undue delay and in any case no later than 14 (fourteen) days from the day on which F-L receives the returned goods or the customer has unequivocally demonstrated that they have returned the goods, whichever occurs first.

The returned products must be sent to F-L without undue delay and in any case within 14 (days) from the date on which the customer has notified F-L of their intention to withdraw. The date of postage or delivery to the courier shall be deemed to be the date of dispatch. The shipping costs for returned products will be entirely borne by the customer.

Refunds will be made using the same payment method used for the initial transaction.

The customer shall be solely responsible for any decrease in the value of the goods resulting from handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the products.

Please note that:

1. It is strictly prohibited to remove seals or labels;
2. The products must be returned in a sound, clean, intact, and complete condition, including any accessories;
3. Using the products for "trial" purposes before returning them is prohibited;
4. The right of withdrawal does not apply to opened sealed products by the consumer, nor to sealed goods that are not suitable for return for reasons of hygiene or health protection that have been opened after delivery;
5. The right of withdrawal is exclusively reserved for consumers (natural persons who purchase goods for purposes not related to their professional, commercial, or entrepreneurial activity), and therefore cannot be exercised by legal entities and natural persons acting for purposes related to any professional activity they may perform.

In the event that the customer does not comply with the deadlines for the right of withdrawal and return mentioned above, or with the provisions in the previous points 1), 2), 3), 4), and 5), F-L shall not be obliged to refund the purchase price of the products to the customer. If the customer has nonetheless returned such products, they may request F-L to resend the same purchased items, but with shipping costs entirely borne by the customer.

DIRITTO DI RECESSO

Il cliente che riveste la qualità di consumatore ha il diritto di recedere dal contratto di acquisto stipulato con F-L, senza alcuna penalità e senza indicarne le ragioni. Il periodo di recesso scade dopo 14 (quattordici) giorni dalla data in cui il cliente o un terzo, diverso dal corriere e dal cliente designato, acquisiscono il possesso fisico dei prodotti.

In caso di recesso dal presente contratto, saranno rimborsati al cliente tutti i pagamenti che ha effettuato a favore di F-L, compresi i costi di consegna (ad eccezione dei costi supplementari derivanti dalla eventuale scelta da parte del cliente di una tipologia di consegna diversa da quella standard offerta da F-L), senza indebito ritardo e in ogni caso non oltre 14 (quattordici) giorni dal giorno in cui F-L riceve i beni prodotti restituiti o il cliente ha inequivocabilmente dimostrato di aver rispedito i beni, a seconda di quale situazione si verifichi prima.

I prodotti resi devono essere spediti a F-L senza indebito ritardo ed in ogni caso entro 14 (giorni) dalla data in cui il cliente ha comunicato a F-L la sua intenzione di recedere. Farà fede la data di invio postale o di consegna al corriere. I costi di spedizione dei prodotti resi saranno integralmente a carico del cliente.

I rimborsi saranno effettuati utilizzando lo stesso mezzo di pagamento usato per la transazione iniziale.

Il cliente sarà unicamente responsabile della diminuzione del valore dei beni risultante da una manipolazione dei beni diversa da quella necessaria per stabilire la natura, le caratteristiche ed il funzionamento dei prodotti.

Si precisa che:

1. È assolutamente vietato rimuovere sigilli o etichette;
2. I prodotti devono essere spediti sani, puliti, integri e completi, anche di eventuali accessori;
3. È vietato utilizzare i prodotti per finalità di “prova” prima di effettuare il reso;
4. Il diritto di recesso non si applica ai prodotti sigillati aperti dal consumatore, né ai beni sigillati che non si prestano ad essere restituiti per motivi igienici o connessi alla protezione della salute che sono stati aperti dopo la consegna;
5. Il diritto di recesso è riservato esclusivamente ai consumatori (persone fisiche che acquistano i beni non per scopi legati alla propria attività professionale, commerciale o imprenditoriale), quindi non può essere esercitato dalle persone giuridiche e dalle persone fisiche che agiscono per scopi riferibili all'attività professionale eventualmente svolta.

Nel caso in cui il cliente non rispetti i termini per il diritto di recesso e di reso sopraindicati, oppure le disposizioni di cui ai precedenti punti 1), 2), 3), 4) e 5), F-L non sarà tenuta a rimborsare il prezzo d’acquisto dei prodotti al cliente. Nel caso in cui il cliente abbia comunque restituito tali prodotti, potrà domandare a F-L di rinviargli i medesimi articoli acquistati, ma con spese di spedizione totalmente a carico del cliente.
